A.P.I. Agent of Real Estate Property: Are the specialists of the real estate market. It's a colleged collective and have to submit to the professional ethics that arise from the norms established by the Official College of Real Estate Property Agents.
Property Registrar: Can advise you on the legal situation of the home you wish to buy: levies, mortgages, limits, etc. This consultation is totally essential and imperative before you make the decision to purchase.
Public Notary: Is whom guarantees and legalises the agreement of Purchase making out the Public Scriptures. He will advise you on how to comply with the current civil, administrative and fiscal laws.
Preliminary Agreement.
It is very convenient that before formalising the purchase, that the Real Estate Agent promotes a preliminary agreement between the seller and the buyer, by the use of a document signed by both parties.
This document must contain: names, identity documents and address of both parties, the identification of the property object of the purchase, the agreed price, way of payment and deposit made as way of formalising the agreement.
This document must also contain and specifically mention who will pay all the costs and taxes of the purchase and the date in which the Public Scriptures will be made formal.
Our advice is that the deposit does not exceed 10% of the total amount of the purchase, as this is a reasonable non-abusive amount for both parties.
The buyer will lose the amount paid as deposit, if there is a breach of contract on his part. If it is the seller who does not fulfil the contract, he must return double the amount paid as deposit.
This preliminary agreement must be formalised by Public Scriptures before a Public Notary and must be inscribed in the Property Registry.
The procedures of registry and payment of added value tax and other taxes can be done through the Real Estate Agency or in any Gestoria that you trust in.
Costs and Financing.
The total amount of all the costs of the purchase can add up to approximately 10% of the scripture price and are the following:
Impuesto sobre Transmisiones Patrimoniales (Tax on Patrimony Transmissions): levied on the purchase of homes and mortgage loans and is 7% of the price listed on the Scriptures. If the home is new, this tax converts to IVA and is 7%.
Impuesto sobre Actos Jurídicos Documentados (Tax on Documented Legal Acts): levied on the purchase of homes and mortgage loans and is 0,5% of the price of the Scriptures.
Plusvalia (Added Value): This is a tax on the appreciation of the value of urban land. It depends on the cadastre value of the terrain and the number of years that have passed since the last transmission.
Notary, Registry and Gestoria: the costs that correspond to the Public Scriptures, Registry of the property and the handling of procedures by the Gestoria.
Mortgage Loan: these costs will depend on the modality and type of mortgage and will be specified.
The financing of the purchase is usually done with a long term mortgage loan, with the home that has be bought as guarantee of the loan. Important fiscal benefits can be obtained if the home is to be used as the habitual residence.
Your Real Estate Agency will inform you of the different modalities of mortgages, interest types, costs, payment terms and quotas, so that you may choose what is more convenient for you. You will also be advised on the documents you have to present and, if you wish, they will handled the concession of the credit.
